Record-Keeping Requirements

All visual content depicting actual or simulated sexually explicit conduct that is hosted on or transmitted through NSFW Market is subject to the record-keeping requirements of 18 U.S.C. § 2257 and 28 C.F.R. Part 75.

Primary Producer Responsibility

NSFW Market operates as a marketplace platform. Individual sellers (content creators) are the primary producers of their content and are responsible for maintaining all records required by 18 U.S.C. § 2257, including:

• Government-issued photo identification for each performer.
• Proof that each performer was at least 18 years old at the time of production.
• Cross-referencing records linking performers' legal names to any stage names.

Platform Obligations

As a secondary producer / hosting platform, NSFW Market requires all sellers to:

• Verify their identity through our identity verification process.
• Certify that all individuals depicted are at least 18 years old.
• Maintain 2257 records and make them available for inspection upon request.
• Include a 2257 compliance statement with content where applicable.

Exemptions

Content that does not depict actual sexually explicit conduct, such as text-only listings, item photographs (clothing, accessories), and non-explicit modeling photos, is exempt from 2257 record-keeping requirements.

Reporting

If you believe any content on NSFW Market violates these requirements or depicts a minor, please report it immediately to compliance@nsfwmarket.com. All such reports are treated with the highest priority.
